Agreement to Terms

By accessing or using OceansWave ("the Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.

Description of Service

OceansWave is a privacy-focused voice messaging platform that provides:

• End-to-end encrypted voice messaging
• Self-destructing messages with configurable burn timers
• Zero-knowledge architecture ensuring message privacy
• Secure key management with user-controlled backup

Account Registration

To use OceansWave, you must:

• Be at least 13 years old (or the minimum age in your jurisdiction)
• Provide a valid email address
• Maintain the security of your account credentials
• Securely store your encryption key backup (24-word recovery phrase or QR code)

You are solely responsible for all activity on your account and for maintaining the confidentiality of your credentials and encryption keys.

Encryption Key Responsibility

You accept full responsibility for backing up your encryption keys. OceansWave cannot be held liable for data loss resulting from lost keys.

Acceptable Use

You agree not to use OceansWave to:

• Violate any applicable laws or regulations
• Harass, threaten, or harm others
• Distribute malware, viruses, or malicious content
• Attempt to circumvent security measures or access unauthorized systems
• Impersonate others or create fraudulent accounts
• Send spam or unsolicited messages
• Engage in any activity that could damage, disable, or impair the Service

While we cannot see your message content due to encryption, we reserve the right to terminate accounts that are reasonably believed to violate these terms based on usage patterns or reports.

Self-Destructing Messages

The burn timer feature permanently deletes messages after the specified time. You understand that:

• Deleted messages cannot be recovered by anyone, including OceansWave
• The burn timer starts after listening the voice message.
• You are responsible for setting appropriate burn times for your needs
• OceansWave makes no guarantees about message persistence beyond the burn timer

Intellectual Property

The Service, including its design, features, and technology, is owned by OceansWave. You retain ownership of the content you create and share through the Service.

By using OceansWave, you grant us a limited license to transmit and store your encrypted content solely for the purpose of delivering the Service.

Service Availability

We strive to provide reliable service but cannot guarantee:

• 100% uptime or uninterrupted access
• Error-free operation
• Compatibility with all devices or browsers
• Preservation of data beyond specified retention periods

The Service is provided "as is" and "as available" without warranties of any kind.

Limitation of Liability

To the maximum extent permitted by law, OceansWave shall not be liable for:

• Loss of encryption keys or recovery phrases
• Inability to access messages due to lost keys
• Data loss resulting from service interruptions
• Messages deleted by burn timers as intended
• Any indirect, incidental, or consequential damages

Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim.

Account Termination

You may delete your account at any time through the app settings. Upon deletion:

• Your account information will be removed
• Any remaining encrypted messages will be deleted
• This action is irreversible

We may also terminate or suspend your account if we believe you have violated these terms.

Changes to Terms

We may update these Terms periodically. Significant changes will be communicated through the app or email. Continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws of United Arab Emirates, without regard to conflict of law principles.
